…they were firing gunshots - you know, unnecessary drama – Lawyers
KANAKANTAPA, Friday, September 29, 2023 ——-The conduct of the police in the case involving Socialist Party (SP) National Youth Secretary Elias Gabriel Banda has continued raising people’s eyebrows.
Mr Banda was arrested yesterday for the two offences of Proposing Violence and Criminal Trespass.
Giving an update on the matter today, one of Mr Banda’s lawyers, Simon Mwila Mulenga expressed shock at the decision by the police to move the suspect from Chelstone Police Station in a questionable way.
Mr Mulenga said the suspect was carried in a very unfortunate way, “he was carried by the C5.”
“Now, what again we find strange is that our client, they wrote that he was taken to Lilayi but they have brought him this far… he was carried in a very unfortunate way, he was carried by the C5. They were firing gunshots, you know, unnecessary drama. The offences he is alleged to have committed are misdemeanors,” he said.
“We received disturbing news last night that Gabriel had actually been moved from Chelstone Police. We left him in the lawful custody of Chelstone Police and the arresting officer assured us that he will be given police bond once he meets everything that is supposed to be handed over to the police.”
The Lawyer explained that Mr Banda met all police bond requirements.
“…but of course she (the arresting officer) has been elusive, she is nowhere to be seen. The next thing we get is a report that our client has been moved from Chelston Police. Now, what is very strange or what is very funny is that we were told that Gabriel is being moved together with other colleagues because they needed to decongest the police,” he said.
And Mr Miyanda Banda, another lawyer representing the suspect wondered why the police had issued contradicting statements on the matter.
“Basically we came to visit our client. My colleague came at 06:30 but he was not allowed entry by the police, and I came and joined later…The information they have given us is that my client has been moved to Kanakantapa. I have seen it very strange because when my colleague came, the other counsel, he was told that my client is inside the cells here. So there are two conflicting statements,” Mr Miyanda said.
“So we don’t know whether it was true that my client, Gabriel Banda is in Kanakantapa, Chongwe area to see whether what the police are saying is true or not. Of course you can see that there are a lot of lies, a lot of contradictions with the police. We don’t know their intentions and they know that Gabriel is being represented. When asking them what time Gabriel was taken to Nakantapa they said I should get in touch with Rae Hamoonga, very very strange position.”

كاناكانتابا ، الجمعة 29 سبتمبر 2023 ——- استمر سلوك الشرطة في القضية المتعلقة بسكرتير الشباب الوطني للحزب الاشتراكي (SP) إلياس غابرييل باندا في إثارة دهشة الناس.
تم القبض على السيد باندا أمس لارتكابه جريمتي اقتراح العنف والتعدي الإجرامي.
في معرض تقديمه لتحديث حول الأمر اليوم، أعرب سيمون مويلا مولينجا، أحد محامي السيد باندا، عن صدمته من قرار الشرطة بنقل المشتبه به من مركز شرطة شيلستون بطريقة مشكوك فيها.
وقال السيد مولينجا إن المشتبه به تم نقله بطريقة مؤسفة للغاية، "تم نقله بواسطة C5".
"الآن، ما نجده غريبًا مرة أخرى هو أن عميلنا، كتب أنه تم نقله إلى ليلاي لكنهم أوصلوه إلى هذا الحد ... لقد تم نقله بطريقة مؤسفة للغاية، تم نقله بواسطة C5. لقد كانوا يطلقون أعيرة نارية، كما تعلمون، دراما غير ضرورية. وأضاف أن الجرائم المنسوبة إليه هي جنح.
"تلقينا أخبارًا مزعجة الليلة الماضية مفادها أن غابرييل قد تم نقله بالفعل من شرطة شيلستون. لقد تركناه في الحجز القانوني لدى شرطة تشيلستون وأكد لنا الضابط الذي اعتقله أنه سيحصل على كفالة الشرطة بمجرد استيفاء كل ما يفترض أن يتم تسليمه إلى الشرطة.
وأوضح المحامي أن السيد باندا استوفى جميع متطلبات سندات الشرطة.
"...ولكن بالطبع كانت (الضابطة التي قامت بالاعتقال) بعيدة المنال، ولا يمكن رؤيتها في أي مكان. والشيء التالي الذي حصلنا عليه هو تقرير يفيد بأن عميلنا قد تم نقله من شرطة تشيلستون. وقال: "الأمر الغريب أو المضحك للغاية الآن هو أنه قيل لنا إنه تم نقل غابرييل مع زملاء آخرين لأنهم بحاجة إلى تخفيف الاحتقان على الشرطة".
وتساءل السيد مياندا باندا، وهو محام آخر يمثل المشتبه به، عن سبب إصدار الشرطة لبيانات متناقضة حول هذا الموضوع.
"لقد جئنا في الأساس لزيارة عميلنا. جاء زميلي في الساعة 06:30 ولكن لم تسمح له الشرطة بالدخول، وحضرت وانضممت لاحقًا... المعلومات التي قدموها لنا هي أن موكلي قد تم نقله إلى كاناكانتابا. لقد رأيت الأمر غريبًا للغاية لأنه عندما جاء زميلي، المحامي الآخر، قيل له إن موكلي موجود داخل الزنازين هنا. وقال مياندا: “لذا هناك تصريحان متضاربان”.
"لذلك نحن لا نعرف ما إذا كان صحيحًا أن موكلي، غابرييل باندا، موجود في كاناكانتابا بمنطقة تشونغوي لمعرفة ما إذا كان ما تقوله الشرطة صحيحًا أم لا. بالطبع يمكنك أن ترى أن هناك الكثير من الأكاذيب والكثير من التناقضات مع الشرطة. لا نعرف نواياهم وهم يعلمون أن جبريل ممثل. عندما سألوهم عن الوقت الذي تم فيه نقل غابرييل إلى ناكانتابا قالوا إنه يجب علي التواصل مع راي هامونجا، وهو موقف غريب جدًا.
