L'ambiguïté n'exclut pas la nécessité évidente de mettre fin au génocide et d'exiger un cessez-le-feu immédiat !
Le 26 janvier, la Cour internationale de justice de La Haye a rendu sa décision sur la requête d'accusation de génocide portée par l'Afrique du Sud contre d'Israël. L'Afrique du Sud demandait à la Cour d'ordonner des mesures provisoires pour mettre fin à l'assaut qu'Israël poursuit impunément à Gaza. Elle a notamment demandé qu'il soit ordonné à Israël de « suspendre immédiatement ses opérations militaires à et contre Gaza » et de laisser entrer l'aide humanitaire.
En résumé, la Cour se déclare compétente pour statuer sur la requête. Elle ordonne à Israël de prendre des mesures pour prévenir les actes de génocide dans la bande de Gaza. Elle déclare qu'Israël doit empêcher et punir l'incitation au génocide et permettre l'entrée de l'aide humanitaire. Elle oblige Israël à prendre des mesures pour protéger les Palestiniens, mais ne lui ordonne pas de mettre fin aux opérations militaires dans la bande de Gaza.
Que faut-il en tirer ?
Il est clair que l'arrêt du 26 janvier représente une défaite pour Israël dans la mesure où Israël avait demandé que la requête soit abandonnée au motif qu'il affirme ne pas commettre de génocide à Gaza. Le fait que la Cour se déclare compétente pour entendre cette cause signifie que la détermination du cas de génocide se poursuivra pendant un certain temps encore.
L'arrêt de la CIJ arrêt est aussi un excellent exemple d'ambiguïté. Qu'est-ce que l'ambiguïté ? L'ambiguïté ne signifie pas que le problème n'est pas clair. Il est très clair qu'Israël assassine les Palestiniens en toute impunité. Il est on ne peut plus clair qu'Israël a créé les conditions de la famine et de la propagation de la maladie. Il est clair également qu'il nie commettre un génocide ou entraver l'entrée de l'aide humanitaire puisqu'il accuse le Hamas de tous les maux. Blâmer la résistance pour l'oppression, l'impunité, l'esclavage, la persécution et toutes les injustices n'a rien de nouveau, c'est le discours de tous les oppresseurs de l'histoire.
Il est également très clair que le fait qu'Israël nie être engagé dans un génocide ou avoir l'intention de commettre un génocide signifie qu'il incombe au monde entier d'arrêter Israël. En fait, loin de s'arrêter, Israël continue d'intensifier son assaut génocidaire avec la ferme intention d'éliminer tous les Palestiniens de tout le territoire de la Palestine avant qu'il n'en soit arrêté – soit par le retrait du soutien des États-Unis et des grandes puissances, soit par un soulèvement du peuple en Israël contre le gouvernement criminel de Netanyahou et les autres criminels de guerre qui le composent, soit parce qu'il ne peut plus supporter les pertes en personnel et en matériel militaire qu'il subit aux mains de la résistance, soit parce que les forces d'occupation refusent en masse de servir... Israël cherche à faire le plus de gains possibles sur le terrain dans l'espoir qu'ils deviennent irréversibles. Il a presqu'entièrement rasé la bande de Gaza et éliminé sa population, il est allé jusqu'à bombarder les camps de réfugiés dans les endroits où il avait ordonné l'évacuation de la population et a délibérément créé les conditions de la famine et de la propagation de la maladie, sans compter les pertes massives subies sur le plan des vies humaines et l'impact sur le psychisme humain.
Si tout cela est clair, où se trouve l'ambiguïté du jugement de la CIJ si ce n'est dans l'argumentation sur l'issue à la situation ? Pour l'instant, tout est encadré par de fausses options : soit Israël arrête parce que la Cour lui a ordonné d'arrêter, soit Israël arrête parce que les peuples du monde comptent sur les États-Unis et « Joe le génocidaire » pour lui ordonner d'arrêter. En fait, la voie d'issue est le succès du mouvement de résistance et des peuples du monde qui s'expriment en leur nom propre. C'est la défense du droit d'être et du droit de retour du peuple palestinien et la demande que les gouvernements retirent le soutien qu'ils donnent au génocide sous prétexte qu'il n'est pas clair qu'Israël commet un génocide, que sa campagne meurtrière contre ceux qu'il prétend être des terroristes est légitime, que l'opposition à Israël est de la haine, de l'antisémitisme, du terrorisme, du fanatisme et ainsi de suite.
L'absence de toute mention d'un cessez-le-feu dans l'arrêt de la CIJ rappelle que c'est le peuple palestinien et les peuples du monde qui, en faisant entendre leur voix, en formulant leurs demandes et en énonçant ce qui est nécessaire pour défendre la Palestine et arrêter Israël, seront décisifs.
Pour la Résistance palestinienne et les peuples du monde, la décision de la Cour internationale de justice est très claire : c'est par la lutte que nous vaincrons. Continuons à parler en notre nom en appui au droit d'être et au droit de retour du peuple palestinien. Ne permettons pas que les paramètres de la discussion soient fixés par les pays impérialistes et leurs médias, leurs experts et leurs apologistes. Laissons les peuples du monde présenter leurs arguments à partir de leur point de vue, le seule qui permette de démêler la situation de façon qui soit favorable au peuple palestinien. Ce sont les peuples qui décideront de l'issue de ce tournant dans l'histoire de l'humanité.
Dans cette conjonction historique, il est crucial de frapper au coeur de l'usurpation de pouvoir par Israël, les gouvernements des États-Unis, du Canada et d'autres, qui nous maintiennent dans l'ambiguïté pour nous forcer à discuter des préoccupations qu'eux mettent de l'avant. Ils maintiennent l'ambiguïté afin que nous n'examinions pas les rapports humains qui existent où les peuples du monde ont leurs propres préoccupations et leur propre voix pour parler en leur propre nom.

والغموض لا يستبعد الحاجة الواضحة إلى وقف الإبادة الجماعية والمطالبة بوقف فوري لإطلاق النار!
وفي 26 يناير/كانون الثاني، أصدرت محكمة العدل الدولية في لاهاي قرارها بشأن طلب جنوب أفريقيا ارتكاب إبادة جماعية ضد إسرائيل. وطلبت جنوب أفريقيا من المحكمة أن تأمر باتخاذ تدابير مؤقتة لوضع حد للهجوم الذي تواصله إسرائيل في غزة دون عقاب. وطالبت على وجه الخصوص بإصدار أمر لإسرائيل "بالتعليق الفوري لعملياتها العسكرية في غزة وضدها" والسماح بدخول المساعدات الإنسانية.
وباختصار، تعلن المحكمة اختصاصها بالحكم في الطلب. ويأمر إسرائيل باتخاذ التدابير اللازمة لمنع أعمال الإبادة الجماعية في قطاع غزة. وينص على أنه يجب على إسرائيل منع ومعاقبة التحريض على الإبادة الجماعية والسماح بدخول المساعدات الإنسانية. ويطالب إسرائيل باتخاذ إجراءات لحماية الفلسطينيين، لكنه لا يأمرها بإنهاء العمليات العسكرية في قطاع غزة.
ماذا يجب أن نتعلم منه؟
ومن الواضح أن الحكم الصادر في 26 يناير/كانون الثاني يمثل هزيمة لإسرائيل، حيث طلبت إسرائيل إسقاط الطلب على أساس أنها تدعي عدم ارتكاب إبادة جماعية في غزة. وحقيقة أن المحكمة أعلنت اختصاصها للنظر في هذه القضية يعني أن البت في قضية الإبادة الجماعية سيستمر لبعض الوقت في المستقبل.
ويشكل حكم محكمة العدل الدولية أيضاً مثالاً ممتازاً للغموض. ما هو الغموض؟ الغموض لا يعني أن المشكلة غير واضحة. ومن الواضح جدًا أن إسرائيل تقتل الفلسطينيين دون عقاب. ولا يمكن أن يكون أكثر وضوحا أن إسرائيل هيأت الظروف للمجاعة وانتشار الأمراض. ومن الواضح أيضًا أنه ينفي ارتكاب جرائم إبادة جماعية أو عرقلة دخول المساعدات الإنسانية، حيث يتهم حماس بكل الشرور. إن إلقاء اللوم على المقاومة بسبب القمع والإفلات من العقاب والعبودية والاضطهاد وكل أشكال الظلم ليس بالأمر الجديد، بل هو خطاب كل الظالمين في التاريخ.
ومن الواضح جدًا أيضًا أن حقيقة إنكار إسرائيل تورطها في إبادة جماعية أو نيتها ارتكاب إبادة جماعية يعني أن مسؤولية إيقاف إسرائيل تقع على عاتق العالم أجمع. في الواقع، وبعيدًا عن التوقف، تواصل إسرائيل تكثيف هجومها على الإبادة الجماعية بنية حازمة تتمثل في القضاء على جميع الفلسطينيين من كامل أراضي فلسطين قبل أن يتم إيقافه - إما عن طريق سحب دعم الولايات المتحدة والقوى العظمى، أو عن طريق الانتفاضة. الشعب في إسرائيل ضد حكومة نتنياهو المجرمة ومجرمي الحرب الآخرين الذين يشكلونها، أو لأنها لم تعد قادرة على تحمل الخسائر في الأفراد والمعدات العسكرية التي تتكبدها على يد المقاومة، أو لأن قوات الاحتلال ترفض بشكل جماعي للخدمة... تسعى إسرائيل إلى تحقيق أكبر عدد ممكن من المكاسب على الأرض على أمل أن تصبح هذه المكاسب غير قابلة للتراجع. لقد دمر قطاع غزة بشكل شبه كامل وقضى على سكانه، وذهب إلى حد قصف مخيمات اللاجئين في الأماكن التي أمر فيها بإجلاء السكان وخلق عمدا الظروف للمجاعة وانتشار المرض، ناهيك عن الدمار الشامل. الخسائر التي لحقت بالأرواح البشرية وتأثيرها على النفس البشرية.
وإذا كان كل هذا واضحا، فأين الغموض في حكم محكمة العدل الدولية إن لم يكن في الجدل حول نتيجة الموقف؟ في الوقت الحالي، كل شيء مؤطر بخيارات زائفة: إما أن تتوقف إسرائيل لأن المحكمة أمرتها بالتوقف، أو تتوقف إسرائيل لأن شعوب العالم تعتمد على الولايات المتحدة و"جو الإبادة الجماعية" في أمر التوقف. في الواقع، المخرج هو نجاح حركة المقاومة وشعوب العالم التي تتحدث باسمها. إنه الدفاع عن حق الشعب الفلسطيني في الوجود وحق العودة ومطالبة الحكومات بسحب دعمها للإبادة الجماعية بحجة أنه ليس من الواضح أن إسرائيل ترتكب إبادة جماعية، وأن حملتها القاتلة ضد من يدعي أنهم إن كونهم إرهابيين أمر مشروع، وأن معارضة إسرائيل هي كراهية ومعاداة للسامية والإرهاب والتعصب وما إلى ذلك.
إن غياب أي ذكر لوقف إطلاق النار في حكم محكمة العدل الدولية يذكرنا بأن الشعب الفلسطيني وشعوب العالم هم الذين يسمعون أصواتهم، ويصوغون مطالبهم، ويصرحون بما هو ضروري للدفاع عن فلسطين ووقف إطلاق النار. إسرائيل ستكون حاسمة.
بالنسبة للمقاومة الفلسطينية وشعوب العالم، فإن قرار محكمة العدل الدولية واضح للغاية: بالنضال سننتصر. دعونا نستمر في التحدث باسمنا دعماً لحق الشعب الفلسطيني في الوجود وحقه في العودة. دعونا لا نسمح بأن تحدد البلدان الإمبريالية ووسائل إعلامها ومحلليها ومدافعيها حدود المناقشة. فلتطرح شعوب العالم حججها من وجهة نظرها، وهي الحجة الوحيدة التي تسمح لنا بحل الوضع بطريقة تصب في مصلحة الشعب الفلسطيني. إن الشعب هو الذي سيقرر نتيجة نقطة التحول هذه في تاريخ البشرية.
وفي هذا المنعطف التاريخي، من الأهمية بمكان أن نضرب في قلب اغتصاب السلطة من قبل إسرائيل وحكومات الولايات المتحدة وكندا وغيرها، الذين يبقوننا في حالة من الغموض لإجبارنا على مناقشة المخاوف التي طرحوها. إنهم يحافظون على الغموض حتى لا نفحص العلاقات الإنسانية الموجودة حيث يكون لشعوب العالم اهتماماتهم الخاصة وأصواتهم الخاصة للتحدث عن أنفسهم.

Ruling of International Court of Justice in The Hague
Ambiguity Does Not Rule Out Clear Need to Stop Israeli Genocide and Demand Cease Fire Now!
On January 26, the International Court of Justice in The Hague issued its ruling in the case of South Africa's charge of genocide against Israel. South Africa's case required the court to order provisional measures to end Israel's assault on Gaza which it is carrying out with impunity. In particular South Africa called for Israel to be ordered to “immediately suspend its military operations in and against Gaza” and for humanitarian aid to be allowed in.
In brief, the court says it has jurisdiction to rule in the case. The court orders Israel to take measures to prevent acts of genocide in the Gaza Strip. The court says Israel must prevent and punish incitement to genocide and must allow humanitarian aid into Gaza. The court obliges Israel to take more measures to protect Palestinians but does not order it to end military operations in the Gaza Strip.
So what does all this amount to?
It is clear that Israel has suffered a defeat at the hands of the court since it demanded the case be dropped on the grounds that it is not committing genocide in Gaza. The fact that the court says it has jurisdiction in the case means that for some time to come, the determination of the case of genocide will continue.
It is also clear that the ruling is a prime example of ambiguity. What is ambiguity? Ambiguity does not mean that the problem is unclear. It is very very clear that Israel is assassinating the Palestinian people with impunity. It is very very clear that it has created the conditions of famine and the deadly spread of disease. Further, it is clear that it denies that it is committing genocide or interfering with the entry of humanitarian aid since it blames Hamas for everything. Blaming the resistance to oppression, to impunity, to slavery, to persecution and all injustice is nothing new. It is the narrative of every oppressor throughout history.
It is furthermore very clear that Israel's denial that it is engaged in genocide or has the intent to commit genocide means that it is up to the entire world to stop Israel.
In fact, far from stopping, Israel continues to step up its genocidal assault against the Palestinian people with the clear intention of wiping them out from all the territory of Palestine before it is stopped -- either as a result of the withdrawal of support of the U.S. and major powers, or because the people within Israel effectively rise up against the criminal government of Netanyahu and other war criminals which comprise it, or because it can no longer sustain the losses of personnel and military equipment it is suffering at the hands of the resistance, or because the Occupation Forces en masse refuse to serve. It is putting facts on the ground as fast as possible in the hopes that they become irreversible. Beginning with flattening the Gaza Strip in its entirety and wiping out its population. It has gone so far as to bomb the refugee camps in places it ordered the people to evacuate to and to deliberately create the conditions for starvation and famine and the deadly spread of disease, besides the massive losses incurred to human beings and the human psyche.
So, if all this is clear, wherein lies the ambiguity of the ruling if not in the argument over alternatives? At the moment, everything is framed within false alternatives that either Israel stops because the court ordered it to stop, or Israel stops because the peoples of the world count on the U.S. and "Genocide Joe" to order them to stop. In fact, the alternative is the success of the resistance movement and the peoples of the world who are speaking in their own names upholding the right to be of the Palestinian people and their right of return, and demanding that their governments withdraw their support for genocide. Such support is provided under the guise that it is not clear that Israel is committing genocide, that its murderous campaign against those it alleges are terrorists is legitimate, that those who oppose what Israel is doing are engaged in hate, are anti-semites, terrorists, fanatics and so on.
The absence of any mention of a ceasefire by the ICJ reinforces that fact that it is the Palestinian people and peoples of the world, using their voice, making their demands and working out what is needed to defend Palestine and stop Israel that will be decisive.
For the Palestinian Resistance and the peoples of the world, the ruling of the International Court of Justice is very clear: fight to win. Keep speaking up in our own name in support of the Palestinian people's right to be and their right of return. Do not permit the agenda of the discussion to be set by the imperialist countries and their media, their pundits and apologists. Let the peoples of the world present their arguments from their vantage point which is the one which helps sort out this state of affairs in a manner which favours the Palestinian people. They will decide the outcome of this turning point in the history of humankind.
At this historical juncture, it is crucial to hit at the heart of the usurpation of power by Israel, the governments of the U.S., Canada and others, which is to keep us in the ambiguity which tricks us into discussing the agenda they put forward. It is to keep us in the ambiguity so that we do not look at the human relations which exist where it is the peoples of the world who have their own agenda and their own voice to speak in their own name.
We say:

Long Live the Palestinian Resistance!
